The lockdown is done for the convenience and safety of the public. What are the rules of lockdown?

Lockdown cases are dealt with in India under the Disaster Management Act 2005 rules.  Legal action can be taken under these sections if you leave the house without emergency during the lockdown.

Punishment will be given under section 188

During the lockdown, if you go out of the house without any reason just for the sake of traveling, then you can be jailed for 1 month under section 188. Under this section, you can be punished with both fine and jail.  The amount of fine can be up to Rs 200.

One year imprisonment under section 144

Section 144 has been imposed in many cities including Delhi. Section 144 is imposed in view of the possibility of worsening of the situation at any place. Due to this, due to the deteriorating situation, there should be no harm to the citizens.
After the imposition of Section 144, not more than four people can stand together on the road.  If a person violates section 144 then the police can arrest that person under section 107 or section 151. Along with this, he can be punished with imprisonment of up to one year, for this offense may be bailable.

Other rules related to lockdown

Even if you lie or make false excuses to get benefits during the lock down, you can be punished with two years in jail or fine or both.
  • Illegal storage of essential goods in lock down can also result in jail term.
  • If any responsible officer misuses his powers during the period of lock down, then he may have to face serious consequences.
  • For spreading false news or rumours, there can be a jail term of one year.

Difference between lockdown and curfew

Lockdown is an administrative order. Lockdown is in force under the Epidemic Diseases Act, 1897.  This act is applicable throughout India. Therefore, curfew has been imposed under Section 144 of the Code of Criminal Procedure. To implement this section, the District Magistrate issues a release. Where this section has been imposed, four or more people gather. Can’t be.
  • On the legal side, curfew has been an established procedure and the administration has experience in implementing it. But, lockdown is a new experiment so some new problems may emerge while implementing it in practicality.
  • Generally, there is no provision of any kind of punishment in lockdown, but if someone violates section-144 during curfew, then he can be imprisoned for four months or fine or both under section-188.
  • Lockdown has probably been used for the first time in the country, while curfew has been used from time to time according to the need.
  • Lockdown is used during health emergency whereas curfew is used when there is an apprehension of law and order situation in the administration.
